Appellant, Dallas Wayne Howard, was charged by information with one count of first degree murder (murder in the perpetration of a robbery), Ind. Code Â§ 35-13-4-1, Burns Â§ 10-3401 (Supp. 1975), and one count of second degree murder, Ind. Code Â§ 35-1-54-1, Burns Â§ 10-3404 (Supp. 1975). In a trial by jury, appellant was found guilty of first degree murder and sentenced to life imprisonment. He filed a motion to correct error which was denied.
