On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted or for peremptory consideration because that court has granted applications for leave to appeal from orders denying summary Disposition on the same issue in Morrison v Dickinson, Nos. 179207, 179635 and in Tapaninen v Puls, No. 180275. The Court of Appeals, at its option, may hold the case in abeyance for those or any other cases in which an issue in this case is to be decided. We do not retain jurisdiction.
